The Failure of the 28-Article Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the announcement of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been contained. A senior US official spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of contrasting events captured the bleak nature of the recent timeframe. By day, diplomatic battles are fought: optimistic declarations are released from various governments. Significant resources is allocated on restraining certain initiatives. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the key method for achieving "peace".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is equipped to monitor projectile deployments from enemy soil, a capability provided through up-to-date information. From observation points, military aircraft that had been deployed to engage hostile cruise missiles streaked across the sky – sophisticated military planes provided to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense activated: multiple launches deployed against a hostile projectile. This was a modern interception technology at work, presumably supplied through partner states. Every firing shakes the surroundings, causing tremors. The brief panic quickly transforms into sober acceptance: perhaps the approaching threat won't cause damage this time, preventing destruction from devastation and another blackout.

Persistent Threats

Following this, a large-caliber weapon engaged a drone close by, part of a mobile-fire group – most likely imported technology. Regrettably, the shots failed to hit the opposing UAV – it continued its flight toward its objective.

Periodically, this carried on until dawn. Kyiv faced the morning news: seven people killed, damage and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As always, everyone still went about their day – experiencing conflict. But those full day encapsulated Ukraine's vital need on Western support – a reliance that European nations are demonstrably unable to substitute in the near term.

Failed Diplomacy

The 28-point plan from Washington provoked deep reactions, discussion and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new approach from Washington adheres to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They stabilise the situation but never actually achieve victory. This pattern will, certainly, persist.

Political Considerations

It is convenient to criticize certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration works based on a premise understood by seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The American government believes that it is impossible to pressure the Kremlin to abandon the areas that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, Washington does minimal to prevent Kremlin actions, through statements or actions, from assuming that the status quo will not shift further in its advantage in the coming year.

Divergent Views

Therefore, the Kremlin is certain that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their motivation to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still persist, progressively conceding civilians and areas but preventing a complete military breakdown until conditions improve in its favour.

Current Realities

Factually, there are no real preconditions for a truce. Now, personal considerations are entering the equation: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any proposal Kyiv finds unacceptable, so that their focus does not shift toward domestic problems. And although their mission will now be considerably more difficult after latest incidents, it remains very improbable that this will change their overall approach.

These two forces are influencing discussions.

Summary and Prospects

It took a mere seven days to terminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, latest revelations, all served their function.

While new plans based on previous concepts are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are founded on Moscow's terms and demonstrate certain reluctance to alter the situation, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, mainly require ongoing international assistance.
